You must not place an order if you know, suspect or ought reasonably to know that the order will not meet these Terms or any applicable legal, safety, delivery or product use requirement.
We may update these Terms from time to time by publishing the updated version on this website. The Terms that apply to your order are the Terms published at the time your order is placed.
4. Food Use, Age and ID Requirements
Food and kitchen use only
Products sold through this website are supplied for baking, whipped cream, dessert preparation, beverage toppings and lawful culinary preparation only. Customers must use products in accordance with manufacturer instructions, product packaging, safety directions and applicable laws.
You must not purchase, request, receive, supply, transfer or use any product from this website for any unsafe, unlawful, improper or non culinary purpose.
Age and eligibility
You must be at least 18 years old, or otherwise meet any higher legal age or eligibility requirement that may apply, to place, receive or use any product purchased from this website. We may require reasonable confirmation that an order can be completed in accordance with these Terms.
ID and handover requirements
We may reasonably request ID at delivery or handover to confirm that the order can be completed in accordance with these Terms and applicable requirements. If ID is not provided when reasonably requested, or if the delivery or handover requirements cannot be completed, we may delay, refuse, cancel or restrict the order.
Customer warranties
By placing an order, you warrant and represent that the products are being purchased for baking, beverage, whipped cream, dessert preparation or lawful culinary preparation only, and that the customer and recipient meet the age, ID, eligibility, delivery and handover requirements in these Terms.
Responsible supply
We may refuse, cancel, restrict or decline to complete an order if we reasonably believe the order does not meet our food use, age, ID, eligibility, delivery, handover, safety or legal requirements. Any refund or delivery fee treatment will depend on the order stage, driver status and these Terms, except where required by law.
5. Orders
When you place an order through the website, you are making an offer to purchase the selected products for the price shown at checkout, including any applicable delivery fee, surcharge, discount or tax.
We may accept or reject an order at our discretion. A binding agreement is formed only when we accept the order and confirm it for processing or delivery.
You are responsible for checking all order details before placing the order, including selected products, quantity, delivery address, contact details, delivery fee, pricing, instructions and notes.
You must provide accurate and complete order information. Incorrect, incomplete or unsuitable delivery details, unavailable contact details, unanswered calls or messages, or unclear delivery instructions may result in delay, failed delivery, cancellation, additional delivery charges or refusal to complete the order, except where required by law.
All products are subject to availability. If a product is unavailable, incorrectly listed, affected by a pricing error, or cannot be supplied, we may contact you to arrange a suitable alternative, delay, cancellation or refund.
We may cancel an order before delivery if we reasonably believe the order cannot be completed safely, lawfully or in accordance with these Terms. Where we cancel an order, any refund will be handled in accordance with these Terms and your rights under the Australian Consumer Law.
6. Price and Payments
All prices are shown in Australian dollars unless otherwise stated. Prices may include GST where applicable.
Payment must be made using one of the payment methods shown at checkout. Available payment methods may change from time to time.
You must not pay, or attempt to pay, using fraudulent, unauthorised or unlawful means. If you use a card or digital wallet, you confirm that you are authorised to use that payment method.
Payments may be processed by third party payment providers such as Stripe, PayPal, Apple Pay, Google Pay or other providers shown at checkout. We do not control those providers and their own terms may also apply.
We do not store full card details on our website. Payment information is handled through our payment processors where applicable.
If a payment is reversed, disputed, charged back, declined, suspected to be fraudulent, or not received in full, we may delay, cancel or refuse to complete the order, except where required by law.
7. Delivery, Handover, Title and Risk
Delivery areas and timing
We deliver to selected areas shown on the website or confirmed at checkout. Delivery availability, delivery fee and ETA may depend on suburb, distance, driver coverage, traffic, order volume, product availability and the time of day.
Delivery times displayed on the website are estimates only. We will aim to deliver within the estimated window where possible, but timing may change due to conditions outside our reasonable control.
Customer availability
Where handover is required, the order must be received in person by the customer or an authorised recipient. If the customer or authorised recipient is not available, does not answer the phone, does not respond to reasonable contact attempts, or cannot complete the delivery and handover requirements, we may delay, cancel or arrange a new delivery depending on driver availability and order status.
Authorised unattended delivery
In limited circumstances, and only where we are satisfied that the required order checks have been completed, including any ID or eligibility checks we reasonably require, and the customer has confirmed that the products are for baking, beverage or culinary preparation only, we may agree to leave the order at the delivery address or another location nominated by the customer.
If an order is left at the delivery address or nominated location with the customer’s written, SMS, order note, recorded phone or other clear authorisation, the order will be treated as delivered at the time it is left there. Risk in the products passes to the customer at that time, except where required by law.
We may rely on delivery notes, SMS messages, call records, order records, driver notes, delivery photos or other reasonable records as evidence of customer authorisation, attempted contact, delivery status or handover status.
We are not responsible for loss, theft, damage, delay in collection, exposure to weather, or access by another person after the order has been left in accordance with the customer’s instructions, except where required by law.
We are not required to leave any order unattended. We may refuse unattended delivery if we consider it unsuitable, unsafe, unlawful, inconsistent with these Terms, or if the delivery, ID, food use or handover requirements have not been completed to our satisfaction.
Title and risk
Title in the products passes to you once payment has been received in full. Risk in the products passes to you once the products are delivered, handed over, or left at an authorised location in accordance with these Terms, except where required by law.
8. Restricted Delivery Locations
We do not deliver to restricted or unsuitable locations, including schools, hospitals, universities, dormitories or similar locations.
We also do not provide late night hotel room handovers. Customers must provide a suitable private delivery address where the order can be received in person and where the delivery and handover requirements can be completed safely.
If an unsuitable delivery address is provided, or if the delivery location creates a safety, legal or handover concern, we may delay, cancel, refuse or restrict the order. Any refund or delivery fee treatment will depend on the order stage, driver status and these Terms, except where required by law.
9. Returns, Cancellations and Refunds
Returns, cancellations and refunds are assessed based on the order status, product condition, delivery status, driver status, fault or issue reported, and your rights under the Australian Consumer Law.
If you wish to cancel an order before dispatch, please contact us as soon as possible. If the order has already been prepared, assigned to a driver, dispatched, delivered, left at an authorised location, or delivery has been attempted, delivery fees or other reasonable costs may apply, except where required by law.
We will not apply delivery fees, cancellation costs or return conditions in a way that limits any rights you may have under the Australian Consumer Law.
For change of mind returns, products must be unused, unopened, in original condition and returned within any timeframe stated on our refund policy page, unless another remedy is required under the Australian Consumer Law.
If there is an issue with your order, please contact us promptly with your order number, details of the issue and any supporting information. We will review the issue and provide a suitable outcome where required.
You can also read our Refund and Return Policy for more information.
10. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights, guarantees, remedies or protections you may have under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you may be entitled to cancel the service contract with us and receive a refund for the unused portion, or compensation for its reduced value. You may also be entitled to a replacement, refund or compensation for goods in circumstances required by law.
Where a claim is valid under the Australian Consumer Law, we will provide the remedy required by law. Where permitted by law, any other warranties, representations or guarantees are excluded to the maximum extent allowed.
11. Disposal and Recycling
Used cream chargers and gas cartridges should not be thrown away randomly, left in public areas or disposed of in a way that may create a safety issue.
Customers should take used items to a suitable recycling or waste facility that can accept metal gas cartridges. Local council and waste facility requirements may vary.
If you are unsure how to dispose of used items, you may contact us and we can help point you in the right direction.
12. Payment Security and Privacy
We may collect and use personal information for the purpose of processing orders, arranging delivery, handling payments, responding to enquiries, managing customer service and meeting legal or operational requirements.
Payment information is processed by third party payment providers where applicable. We do not store full card details on our website.
You must provide accurate contact, delivery and order information. Incorrect or incomplete information may cause delays, failed delivery or cancellation.
For more information about how personal information is handled, please refer to our Privacy Policy if available on the website.
13. Communications and Delivery Records
You agree that we may contact you by phone, SMS, email or other reasonable methods in relation to your order, payment, delivery, handover, refund, customer service or compliance with these Terms.
We may keep reasonable records of order details, messages, call attempts, SMS confirmations, customer instructions, delivery notes, delivery photos, driver notes, payment records and support communications.
These records may be used to confirm order status, customer authorisation, attempted delivery, delivery completion, handover status, refund assessment or compliance with these Terms, except where restricted by law.
14. Limitation of Liability
Nothing in these Terms limits any rights you may have under the Australian Consumer Law or any law that cannot be excluded.
To the maximum extent permitted by law, we are not liable for loss, damage, injury, delay, failure to deliver, business interruption, loss of profit, loss of opportunity, indirect loss or consequential loss to the extent caused or contributed to by events outside our reasonable control, customer error, misuse, unsuitable delivery details, failed handover, authorised unattended delivery, or any act or omission of the customer or recipient.
To the maximum extent permitted by law, our liability for any claim relating to an order is limited to the amount paid for the products that are the subject of the claim, except where a different remedy is required under the Australian Consumer Law.
